1. Introduction
Welcome to HolistiCare.io (“the Platform”). By registering as a coach (“you” or “Coach”) on our Platform, you agree to comply with and be bound by the following Terms and Conditions (“Terms”). Please read them carefully before completing your registration. If you do not agree with these Terms, you should not register or use the Platform.
2. Definitions
- “Platform” refers to HolistiCare.io, including its website, applications, and services.
- “Coach” refers to the individual registering to provide health and wellness coaching services through the Platform.
- “Client” refers to any individual receiving coaching services from the Coach via the Platform.
- “Services” refers to the health and wellness coaching services provided by the Coach through the Platform.
3. Eligibility and Registration
3.1. Eligibility: To register as a Coach on the Platform, you must:
- Be at least 18 years old.
- Possess the necessary qualifications, certifications, and experience in health and wellness coaching.
- Comply with all applicable laws and regulations in the United Kingdom, including but not limited to the Consumer Rights Act 2015 and the Health and Social Care Act 2012.
3.2. Registration Process: During registration, you agree to:
- Provide accurate, current, and complete information about yourself and your qualifications.
- Maintain and promptly update your information to keep it accurate, current, and complete.
- Create a secure password and maintain the confidentiality of your account credentials.
3.3. Account Security: You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use or security breach.
4. Services and Conduct
4.1. Provision of Services: As a Coach on the Platform, you agree to:
- Deliver professional coaching services in accordance with your advertised qualifications and expertise.
- Ensure that all advice and guidance provided are evidence-based and within the scope of your professional competence.
- Obtain appropriate insurance coverage for the services you provide, including professional indemnity insurance.
4.2. Professional Standards: You are expected to:
- Adhere to all applicable laws, regulations, and professional standards governing health and wellness coaching in the UK.
- Maintain the confidentiality and privacy of Client information in compliance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
- Act in the best interests of your clients, providing services that are ethical, professional, and free from conflicts of interest.
4.3. Prohibited Recommendations and Liability:
- Prohibited Recommendations: Coaches are strictly prohibited from recommending or suggesting any substances or methods that may be harmful to Clients or that contravene global health standards and the health regulations of the United Kingdom.
- Liability: In the event that a Coach provides such prohibited recommendations, the Coach shall bear full responsibility for any harm, damage, or issues arising for Clients as a result of these recommendations.
- HolistiCare.io’s Right to Legal Action: HolistiCare.io reserves the right to pursue legal action against the Coach for any violations of this clause.
5. Health and Safety Disclaimer
5.1. Consumer Protection: You must comply with the Consumer Rights Act 2015, ensuring that:
- Services are provided with reasonable care and skill.
- Clients are given clear and accurate information about the services offered, including pricing and any applicable terms.
5.2. Health and Safety: You are responsible for ensuring that your services comply with the Health and Safety at Work Act 1974, taking all reasonable steps to ensure the health and safety of Clients during coaching sessions.
5.3. Advertising Standards: All promotional materials and advertisements must comply with the Advertising Standards Authority (ASA) guidelines, ensuring that all claims are truthful, not misleading, and substantiated.
6. Fees and Payments
6.1. Fee Structure: You will set your own fees for the services provided. The Platform may charge a commission or fee for facilitating transactions, which will be outlined in a separate agreement.
6.2. Payment Terms: Clients will make payments through the Platform’s payment system. You agree to the payment terms and schedules established by the Platform.
6.3. Taxes: You are responsible for determining and fulfilling your tax obligations related to the payments you receive through the Platform.
7. Confidentiality and Data Protection
7.1. Client Confidentiality: You must maintain the confidentiality of all Client information obtained during the course of providing services, except as required by law or with the Client’s express consent.
7.2. Data Protection Compliance: You must comply with the UK GDPR and the Data Protection Act 2018 in handling personal data, ensuring that Client information is processed lawfully, fairly, and transparently.
8. Use of the Platform
8.1. Termination by Coach: You may terminate your account at any time by providing written notice to HolistiCare.io.
8.2. Termination by HolistiCare.io: We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, HolistiCare.io, or third parties.
9. Termination
