1. Introduction

Welcome to HolistiCare.io (“the Platform”). By registering as a Medical Administrator (“you” or “Administrator”) on our Platform, you agree to comply with and be bound by the following Terms and Conditions (“Terms”). Please read them carefully before completing your registration. If you do not agree with these Terms, you should not register or use the Platform.

2. Definitions

  • “Platform” refers to HolistiCare.io, including its website, applications, and services.
  • “Administrator” refers to the registered medical professional responsible for reviewing blood tests and biomarkers and providing advice to clients through the Platform.
  • “Client” refers to any individual receiving advice from the Administrator via the Platform.
  • “Services” refers to the medical administrative services provided by the Administrator through the Platform.

3. Eligibility and Registration

3.1. Eligibility: To register as an Administrator on the Platform, you must:

  • Be a licensed medical professional in good standing with the General Medical Council (GMC) in the United Kingdom.
  • Possess the necessary qualifications and experience to review blood tests and biomarkers and provide medical advice.
  • Comply with all applicable laws and regulations in the United Kingdom, including but not limited to the Health and Social Care Act 2012.

3.2. Registration Process: During registration, you agree to:

  • Provide accurate, current, and complete information about yourself and your qualifications.
  • Maintain and promptly update your information to keep it accurate, current, and complete.
  • Create a secure password and maintain the confidentiality of your account credentials.

3.3. Account Security: You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use or security breach.

4. Services and Conduct

4.1. Provision of Services: As an Administrator on the Platform, you agree to:

  • Review and interpret blood tests and biomarkers accurately and provide appropriate medical advice to Clients.
  • Ensure that all advice and guidance provided are evidence-based and within the scope of your professional competence.
  • Obtain appropriate insurance coverage for the services you provide, including professional indemnity insurance.

4.2. Professional Standards: You are expected to:

  • Adhere to all applicable laws, regulations, and professional standards governing medical practice in the UK, including the GMC’s professional standards. citeturn0search3
  • Maintain the confidentiality and privacy of Client information in compliance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
  • Act in the best interests of your clients, providing services that are ethical, professional, and free from conflicts of interest.

5. Compliance with UK Laws

5.1. Consent to Treatment: You must ensure that Clients provide informed consent before any medical advice or recommendations are given, in accordance with NHS guidelines. 

5.2. Health and Safety: You are responsible for ensuring that your services comply with the Health and Safety at Work Act 1974, taking all reasonable steps to ensure the health and safety of Clients during consultations.

5.3. Record Keeping: You must maintain accurate and detailed records of all Client interactions and advice provided, in line with GMC guidelines and the Data Protection Act 2018.

6. Confidentiality and Data Protection

6.1. Client Confidentiality: You must maintain the confidentiality of Client information and only disclose it with the Client’s consent or when required by law, as outlined by the GMC’s guidance on confidentiality. 

6.2. Data Security: You must implement appropriate technical and organizational measures to protect personal data against unauthorized or unlawful processing and against accidental loss, destruction, or damage.

7. Use of the Platform

7.1. Acceptable Use: You agree to use the Platform solely for lawful purposes and in accordance with these Terms. You must not use the Platform to engage in any conduct that is unlawful, unethical, or harmful to others.

7.2. Intellectual Property: All content and materials available on the Platform are the intellectual property of HolistiCare.io or its licensors and are protected by applicable copyright and trademark laws. Unauthorized use of any materials is prohibited.

8. Limitation of Liability

8.1. No Warranty: HolistiCare.io provides the Platform “as is” and makes no warranties regarding the accuracy, reliability, or availability of the Platform.

8.2. Limitation of Liability: To the fullest extent permitted by law, HolistiCare.io shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with your use of the Platform.

9. Termination

9.1. Termination by Administrator: You may terminate your account at any time by providing written notice to HolistiCare.io.

9.2. Termination by HolistiCare.io: HolistiCare.io reserves the right to suspend or terminate your account and access to the Platform at its sole discretion, without notice, for conduct that HolistiCare.io believes violates these Terms or is harmful to other users of the Platform, HolistiCare.io, or third parties.

10. Amendments

10.1. Modification of Terms: HolistiCare.io may modify these Terms at any time. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.

11. Governing Law

11.1. Jurisdiction: These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles.
